SCOTUS To Hear Patentable Thought Case

Slashdot | SCOTUS To Hear Patentable Thought Case

The Supreme Court of the United States will hear a landmark patent case involving whether or not thoughts and relationships are patentable.

Michael Crichton's essay in the New York Times attempts a thoughtful summary of Metabolite's primary assertion: they not only own the connection between homocysteine levels in the blood and vitamin B12 deficiency, but also any thought connecting the two.

Here's more ownership of concepts news...

Slashdot | Marvel and DC Enforce "Superhero" Trademark

GeekPunk is announcing that their flagship comic book title featuring superheroes patronizing their favorite bar & grill during their off-hours will now be entitled Hero Happy Hour beginning with the fifth issue of the ongoing series.

According to creator Dan Taylor, "The decision to change the title was brought upon by the fact that we received a letter from the trademark counsel to 'the two big comic book companies' claiming that they are the joint owners of the trademark 'SUPER HEROES' and variations thereof."

Read the recent boingboing post for more background as well.

The runaway definitions of what is and isn't patentable is what leads to things like that ridiculous Blackberry settlement. It is slowly getting to the point where nobody has to actually do any research to get a patent. All they have to do is come up with something that they'd like to invent, and then wait for someone else to do it.

If that's the case I wonder if anyone has patented sharks with fricking laser beams on their heads yet. If not I'm making an appointment with a lawyer tomorrow. Because you know someone is going to do it someday.
